اتعلیمی کمیٹی نے رپورٹ پی ٹی آئی کے صدر عمران خان کو پیش کر دی۔

خان کو "جھوٹے بیانات" دینے پر میانوالی میں ان کی نشست سے نااہل قرار دیا گیا تھا۔

اسلام آباد: الیکشن کمیشن آف پاکستان (ای سی پی) نے پاکستان تحریک انصاف (پی ٹی آئی) کے سربراہ عمران خان کو وارننگ جاری کرتے ہوئے ان کی اہمیت کے باوجود پارٹی میں اعلیٰ عہدے حاصل کرنے پر وضاحت طلب کرلی۔

انتخابی ادارے نے گزشتہ ماہ توشہ خانہ کیس میں سابق وزیراعظم کے خلاف منفی فیصلے کے بعد خان کو پارٹی صدر کے عہدے سے ہٹانے کی کارروائی شروع کی تھی۔

اکتوبر 2022 میں، خان کا "جھوٹے الزامات اور جھوٹے بیانات" کی وجہ سے ملین اسمبلی کی میانوالی سیٹ سے مواخذہ کیا گیا۔

ایک تازہ ترین موڑ میں، خان نے 11 جنوری کو ہونے والے انتخابات سے قبل کونسل کے مبصر یا وکیل کے ذریعے پوچھ گچھ کرنے کے عمل کی وضاحت کرتے ہوئے اپنا تعاون بڑھایا ہے۔

رپورٹ میں وضاحت کی گئی کہ کمیشن نے 20 دسمبر 2022 کو ایک سماعت کی، جس میں درخواست میں لکھا گیا: "درخواست گزار کو سننے کے بعد، ہمیں ملزم، NA/PTI کے عہدیدار عمران خان نیازی کا پتہ چلا۔" 21 اکتوبر 2022 کو بورڈ آف ڈائریکٹرز کے حکم سے صدر کو عہدے سے ہٹا دیا گیا۔

"کمیشن نے یہ بھی نوٹ کیا کہ اگست PLD 2017 SC692 میں اعلان کردہ سپریم کورٹ آف پاکستان کے فیصلے کے مطابق، وہ کسی سیاسی جماعت کے چیئرمین نہیں ہو سکتے کیونکہ پی ٹی آئی ان کے کام پر بات نہیں کر سکتی۔ اس کے لیے صحیح شخص ہے۔" 11.01.2023 تو آپ (عمران خان) 11 جنوری 2023 کو صبح 10 بجے الیکشن کمیشن آئیں گے۔ عملہ یا ماہر اپنے کام کی وضاحت کرنے کے لیے۔

لاہور ہائیکورٹ نے الیکشن کمیشن کو عمران خان کو چیئرمین پی ٹی آئی تعینات کرنے سے روک دیا۔

واضح رہے کہ عمران خان نے پارٹی سربراہ کو برطرف کرنے کے ای سی پی کے فیصلے کو لاہور ہائی کورٹ میں چیلنج کیا تھا۔ خان کی درخواست کے جواب میں، LHC نے جمعرات کو الیکشن باڈی کو سابق صدر کو پی ٹی آئی کے عہدوں سے ہٹانے سے روک دیا۔

اپنے خط میں، خان نے کہا کہ ای سی پی نے انہیں NA-95 اسمبلی کی نشست سے ہٹائے جانے کے بعد پارٹی قیادت سے ہٹانے کا عمل شروع کیا تھا۔

درخواست میں الزام لگایا گیا کہ ای سی پی نے ان پر جھوٹے بیانات دینے کا الزام لگاتے ہوئے نوٹس جاری کیا تھا۔ لیکن وہ عدالتی فرائض سرانجام نہیں دے سکے۔

درخواست میں کہا گیا کہ عمران خان کی نااہلی غیر ضروری اور غیر قانونی ہے اور انہیں سیاست سے دور رہنے کا نوٹس جاری کیا گیا۔

سابق وزیراعظم نے عدالت سے کہا کہ الیکشن کمیشن کے دائرہ اختیار اور علم کو روکا جائے اور بغیر مواخذے کے ای سی پی کو مطلع کیا جائے جو کہ غیر قانونی ہے۔

عدالت نے نوٹس جاری کرتے ہوئے ای سی پی کو ہدایت کی کہ آئندہ سماعت تک تادیبی کارروائی سے گریز کیا جائے۔
